The Herron v. Southern Pac. Co. court case was about the appealability of judgments entered pursuant to remittiturs in federal courts. The case was decided by the United States Court of Appeals for the Fifth Circuit in 1974. The issue at hand was whether the federal court rules regarding remittiturs, which allow a court to conditionally grant a new trial unless the plaintiff accepts a reduction in the damages award, should apply in federal courts despite a contrary federal practice. The court ultimately held that the federal rules on remittiturs do apply in federal courts, even if the practice in that particular circuit had been different.
