The development and implementation of artificial intelligence (AI) is facing several major legal challenges. These include issues related to algorithmic transparency, cybersecurity vulnerabilities, unfairness, bias, and discrimination, lack of contestability, legal personhood, intellectual property, adverse effects on workers, privacy, and data protection, liability for damage, and lack of accountability. The velocity challenge, which involves the rapid pace of technological change, is another major challenge facing AI regulation. Dealing with this challenge requires focus and agility, with AI placed at the forefront of an agency's remit. Additionally, ethical concerns are mounting as AI takes on a larger role in decision-making, particularly in areas such as health and medicine, employment, creditworthiness, and criminal justice. Ensuring that AI programs are not encoded with structural biases is a major concern, as is addressing issues related to privacy and data protection. Finally, defining AI and related terminology is a subtle but important challenge in regulating AI research.
